Opportunity NJ Inc. is organized as a 501(c)(4) social-welfare organization. The primary purpose of Opportunity NJ Inc. is to further the common good by strengthening the civic engagement of New Jersey’s residents and businesses toward a strong and sustaining state economy.
Individuals and business entities may donate without limit to a 501(c)(4), such as Opportunity NJ Inc. Donations to a 501(c)(4) are generally not deductible as charitable contributions for federal income-tax purposes, but they may be deductible as business expenses.
2. How is Opportunity NJ Inc. different from my 501(c)(6) trade association or chamber of commerce?
As a 501(c)(4) organization, Opportunity NJ Inc. participates in issue advocacy to further public policies that enhance New Jersey’s economy and help keep New Jersey competitive by creating jobs, enhancing business opportunities, and ensuring that the cost of living is more affordable for New Jersey residents Opportunity NJ is focused on issues important to the New Jersey business community as a whole and is not focused on any one particular industry or trade.
3. Does Opportunity NJ Inc. engage in lobbying?
As a 501(c)(4) organization, Opportunity NJ Inc. is focused on education and grassroots activities related to its core issues of strengthening the civic engagement of New Jersey’s residents and businesses toward a strong and sustaining state economy. Opportunity NJ Inc. will not engage in any direct lobbying, but may engage in grassroots lobbying in accordance with New Jersey law.
4. Why should I contribute to Opportunity NJ Inc. in addition to contributing to my trade association or chamber of commerce?
Opportunity NJ Inc. is a coalition of business organizations, trade associations, labor groups, educational institutions, not-for-profits, and individual companies throughout the state of New Jersey. As a 501(c)(4) social-welfare organization, Opportunity NJ Inc. is conducting research and preparing materials as part of an educational campaign related to its core issues of enhancing New Jersey’s economy and helping to keep New Jersey competitive.
Opportunity NJ Inc. recognizes the importance of standing together as a coalition but also recognizes that different trade associations and chambers of commerce may have goals and objectives beyond Opportunity NJ Inc.’s goals of education and issue advocacy. Opportunity NJ Inc. will, therefore, create toolkits that will be provided to Opportunity NJ Inc. contributors. Trade associations and chambers of commerce that contribute to Opportunity NJ Inc. may then use these toolkits to undertake their own lobbying efforts and to educate their trade association and chamber of commerce members in accordance with applicable law.
5. Does Opportunity NJ Inc. have any members?
No. Unlike a 501(c)(6) trade association, Opportunity NJ Inc. (as a 501(c)(4) organization) does not have any members.
6. How are decisions made on behalf of Opportunity NJ Inc.?
Opportunity NJ Inc. is governed by a Board of Directors that makes all decisions, by a majority vote, related to the 501(c)(4)’s operation, messaging, and expenditures, in accordance with Opportunity NJ Inc.’s bylaws.
7. Do contributors have any role in Opportunity NJ Inc.’s decision-making and expenditures?
An Opportunity NJ Inc. contributor may certainly make suggestions and recommendations to the Opportunity NJ Inc. Board of Directors. The Board of Directors will review the suggestions and recommendations it receives from contributors and will make all decisions related to Opportunity NJ Inc.’s operation and expenditures in accordance with the Board’s decision-making authority under Opportunity NJ Inc.’s bylaws.
